Ending 2025 with a nod to all my fellow HR pros gearing up for the Employment Rights Act. If your prep list already feels longer than Santa's, you're not alone! Here’s a quick rundown of what’s coming and what to keep an eye on: 🔹 February 2026 - Industrial Action Reforms: • Dismissal for taking part becomes automatically unfair • Shorter notice periods for industrial action • Simpler ballots and longer mandates • Picket supervisors no longer required 🔹 April 2026 - A Big Month for HR Updates: • Day-one rights for paternity and unpaid parental leave • Simplified union recognition procedures + other union updates • Statutory sick pay from day one (and no earnings threshold) • Protective award for collective redundancy failures doubled • Sexual harassment added to whistleblowing disclosures • Fair Work Agency established 🔹 October 2026 - The Heavy Hitters: • “Fire and rehire” becomes automatically unfair in most cases • Stronger harassment duties, including third-party liability • NDAs restricted in harassment/discrimination cases • Employment tribunal time limits → 6 months • New union rights, access provisions and protections 🔹 And then comes 2027 - home to the sweeping changes: • Unfair dismissal qualification → six months’ service • Removal of the statutory cap on unfair dismissal compensation • Stronger protections for pregnancy and maternity • Guaranteed hours for zero-hours workers • Compensation for cancelled or shortened shifts • Tougher duties when refusing flexible working • Mandatory menopause & gender pay action plans • Broader collective redundancy rules • Further union protections • Regulation of umbrella companies My key takeaways: ➡️ Probation periods will need tighter management with earlier intervention and more robust assessment. ➡️ October 2026 fundamentally reshapes contractual change. With fire-and-rehire off the table, meaningful consultation and mutual agreement move centre stage. ➡️ The removal of the statutory cap on unfair dismissal compensation raises the stakes. Any dismissal decision will need stronger rationale, process, and documentation. The latest CHRO Confidence Index shows fewer leaders plan to expand headcount, but that doesn’t mean confidence is slipping. It means the strategy is sharpening. After several years of whiplash, pandemic shifts, economic uncertainty, and now regulatory flux, CHROs are focusing on building resilience from within. Half are investing in change management training for leaders, and nearly as many are doing the same for managers. That’s a smart move.
