A Position Paper: Policy Issues Related to NJ Public Entity Benefit Plans While we represent employers and plan sponsors nationally, we have a considerable segment of public entities. Among them, New Jersey public entities are facing unprecedented pressure to balance the rising cost of employee health benefits with the obligation to deliver quality coverage while remaining accountable to taxpayers. In many cases, collective bargaining constraints limit the tools available to employers to directly influence cost. At the same time, healthcare inflation continues to accelerate, placing increasing strain on municipal, county, and school district budgets and intensifying the burden on elected officials and taxpayers alike. Against this backdrop, public entities can no longer afford inaction. Employers must take reasonable, disciplined steps to address the specific cost drivers embedded within their benefit plans. This position paper makes clear that despite perceived challenges, New Jersey public employers have a sound legal and collective bargaining foundation to adopt fair, evidence-based cost and quality management strategies consistent with governing law and established precedent. The attached position paper outlines that foundation and supports what NJ public entities can do while balancing the issues of bargaining. It presents the rationale, empirical data, and practical evidence supporting the ability of public entities to proceed responsibly and consistently in implementing effective benefit management programs without violating bargaining obligations. While the attached is not a formal legal opinion, it provides a clear and defensible framework upon which public employers can confidently act to help control escalating healthcare costs while preserving the integrity and sustainability of their benefit plans.
